FX Airguns USA Court Case Update So Far

Back in October 2023, Hard Air Magazine first brought you news about the FX Airguns USA court case. At the time, I predicted that – given the complexity of this case – that it would run for some time before there’s a resolution.

Well, nine months later, it’s still running!

Indeed, the public court records reveal an amazing number of twists, turns and unexpected happenings. All of this is waaaaay too complicated for me to attempt to summarize!

However here’s a few definite outcomes that are covered in recent FX Airguns USA court case documentation…



1. As of the end of June, the costs for FX Airguns USA’s Receiver, plus expenses and his legal counsel exceed $330,000 in total and are still increasing. (Sum of multiple compensation claims by the Receiver).

Remember that this does NOT include the legal costs for any of the people and entities involved – FX Airguns Sweden, FX Airguns USA, Rumpgarden, Everly Holdings, etc.. They would all be additional.

Just imaging what the total of the legal bills must be. Ouch!



2. The official US distributor for FX Airguns and Element Optics is now Marksman Distribution of Orem, Utah. (Shown on the website).



3. The Hall Watters Drive warehouse and offices of FX Airguns USA has been sold. (Shown in General Receiver’s Third Interim Report, July 16, 2024).



4. The bulk of the remaining airguns, optics, ammunition, components, and repair parts at FX Airguns USA were sold to FX Airguns, Sweden. (Shown in General Receiver’s Third Interim Report, July 16, 2024).



5. In addition, Cape Fear Airguns will sell, on a consignment basis, some airguns, optics, ammunition, components, and repair parts not being sold to FX Sweden. (Shown in General Receiver’s Third Interim Report, July 16, 2024).



6. The Receiver also continued to engage in settlement negotiations with counsel for Jonathan Tueller, Evelyn Elvegaard, and EverGuard Holdings, in an effort to reach a comprehensive out-of-court resolution of remaining claims. (Shown in General Receiver’s Third Interim Report, July 16, 2024).


The FX Airguns USA Court Case​


On October 3, 2023, a law suit was filed in the General Court of Justice, Superior Court Division, State of North Carolina, County of Wake. Case Number 2023CVS27939. In it, the plaintiff requests that a General Receiver be appointed for FX Airguns USA, to take control of the company.

Major Warning​


I have zero personal knowledge or “inside information” about FX Airguns or FX Airguns USA.

What I cover here is publicly-available information that anyone can find about the FX Airguns USA court case on the Internet.

However, please remember that – just because it’s published online – it may not necessarily be true. So I make no representation about the truth any of the information published in the links shown here, I’m just saying that you can see it online too.

Also, given that legal action is still in process, anyone commenting on this article needs to be very careful what they say. If not, YOU could end-up being sued, too! HAM Community Moderators will delete anything that we feel is inappropriate for this reason.

Remember the legal process in the USA and most other countries works under the base assumption that any person (or entity) involved in legal action is innocent until proven guilty in a court of law – NOT the court of Social Media, television, airgun forums, our own opinion or anywhere else!

Finally, the FX Airguns USA court case is EXTREMELY complex and the situation is still changing daily.

I've been reading over the dockets periodically. All I can say is that if you want to laugh and get a better idea of what's going on, start reading the initial complaint entitled "Complaint" dated 10/03/23. I've learned a lot reading over these documents.

Yeah it's very interesting, unfortunately some of it has been sealed so sharing screenshots of that information might not be a good idea.

@MountainSportAirguns What I’m sharing is months old information that is open to the public viewed via the link provided in the first post in this thread. Information that has been sealed, I wouldn’t want to intentionally and knowingly put that on public display.


The more I read the more I understand the issues and some of the complexities. There are some strange things going on in this case. The allegations of an attempted buyout of FX USA looks pretty fishy, especially the alleged attempt to persuade Mr. F. Axelsson to sign a non-disparagement agreement. The other thing that stands out glaringly is hiring a person that is not a certified public accountant nor a U.S. citizen to handle finances and bookkeeping. There are other questionable intricacies at play in the complaint and case that lead me to form several opinions. I would like to see how this plays out. I would think the parties involved would seek to settle this as opposed to costly drawn out litigation resulting in court orders. If not, the way it’s looking this can potentially drag on for a few years.
 
Selfishly, I just want to know where all the spare parts are.
And if anyone in the U.S. is really in earnest about serving that need.

@SILENT SQUIRREL Some of that was addressed in the complaint and subsequent documents. From what I gather, several alleged wrongful acts related to this fiasco were explained as “mistakes.”Movement of some “portable assets” was one of those mistakes where some finger pointing occurred when asked why it was moved according to the documents.

Understood!
Those "mistakes" are what lawyers and courts deal with in the time (and charges) it takes to do so.
And considering that it's all about money, nobody really wins except the lawyers
I'm more interested in the practical aspects of getting the stellar parts service FX owners such as myself had become accustomed to.

I should probably take the time and read the documents
But what good is there in having an opinion about something you have actually read

@SILENT SQUIRREL From what I gather Utah Airguns is the “go-to” for parts and service in the States now. I can’t speak to their service because I have not sent them an airgun to repair. I don’t know who else’s services them as of late, but there is a lot going on in this case. Information that comes up in these documents provides insight into multiple things I’ve wondered about regarding products, marketing, and other related topics of personal interest.

I’m not sure what you mean by the last statement, unless you left out the word “not” in the last part of your final sentence.

This morning I read that this case was settled.

It appears that a settlement was reached reached in the 4th quarter of 2024 and litigation is ongoing. I saw an AI generated figure, but until I see a court document reflecting the figure I see no sense in posting any settlement figures. From what I gathered, parties affiliated with FX USA were on the losing side.
